Can a spouse be paid

No. No. The Department of Social Services told the legislature in March 2026 that it currently prohibits spouses, conservators and parents of minor children from being paid caregivers. This covers the program's personal care assistant services, whether through an agency, self-directed, or through Adult Family Living.

The testimony opposed Senate Bill 330, which would have let spouses be paid under the state-funded part of the program. The bill did not pass: its last action was a public hearing on March 3, 2026.
